Riding School Training Agreement

The Client and Forecast Farms agree as follows:

1.The Services. Forecast Farms will provide the Student with one riding lesson per week during weeks that our school is open, and one unmounted horsemanship class per month. Stable operates on an annual term with 4 weeks off throughout the year to give the lesson horses a break, allow students to compete at horse shows, to run special events, allow students to plan holidays without missing lessons and to provide pre scheduled make-up days in the event we have to cancel lessons.

2. Student Requirements

Student agrees to follow all Barn Rules as follow:

Courtesy is expected and manners are required. Help us make the farm a fun, friendly and supportive environment for all! Be nice to others, both people and horses, NO exceptions.
All riders or persons handling a horse must sign a release before riding and/or interacting with any horse in any way. Students/Student’s parent(s)/guardian(s) are responsible for having all guests sign releases which are available in the Stable’s office.
ASTM-rated riding helmets must be worn at ALL times when mounted on a horse.
NO smoking allowed on the Stable premises at any time.
NO Dogs or pets on the Stable property. (They may remain in the car, at all times, with a window open or AC on).
The speed limit on the Stable property is 5-15MPH for the safety of horses, riders and children.
Children must be supervised by an adult at all times.
Appropriate footwear MUST be worn around horses and when handling them, no sandals or flip flops in the barn. NO exceptions.
NO jumping outside of a lesson unless approved by trainer.
We prefer that no treats are given. If you must give treats only to your horse and in feed buckets and not by hand.
Clean up after your horse and yourself. There are trash containers, shovels, brooms and muck buckets available for the disposal of manure, shredded hair, hoof cleanings.
If you don’t do it at home….don’t do it at the Stable. Common sense and courtesy at all times!

3. Tuition. Monthly tuition is based on annual value. Client is required to provide Stable with a valid credit or debit card which will be kept on file and automatically charged $ 300 per month for Bronze Level (1 lessons/week and 1 horsemanship lesson/month) There are no refunds, chargebacks, or credit card disputes allowed for any reason.

4. Scheduling. Student will receive a dedicated time and a day of the week where there will be an appropriate school horse and with a group of riders with similar ability reserved each week. Please remember that Stable operates on an annual term of 49 weeks on and 3 weeks off throughout the year. Stable must pay all costs for the number of school horses needed to teach the scheduled lessons. As a result, Stable’s expenses stay the same, regardless of whether the Student’s lesson is taken. The best way to get the most value out of the program is to make it a priority and a commitment not to miss your dedicated lesson time(s). All lessons canceled by Stable due to unforeseen weather or other circumstances will be rescheduled. If Student would like to make a long-term change to his/her dedicated lesson time, he/she may do so a maximum of 1 time in a 90-day period by providing Stable with written notice of Student’s requested change.

5. Cancellation. This Agreement may be canceled by either party with at least 60 days written notice prior to the desired date of termination, however, no refunds will be given.

6. Additional Services. Additional services (listed below) requested by the Student and which Stable agrees to perform will be automatically charged to the Student’s credit/debit card on file at the time of service at the following rates* below:

8. No Guarantee. Stable does not warrant or guarantee any specific level of performance or results. The results of your riding program are largely based on the Student’s efforts.

9. Communications. Student agrees to communicate all scheduling changes or any other concerns about the program by texting 540-274-1541 by email to denise@forecastfarms.com. All non-emergency communications shall be between 8am and 8pm Monday to Friday.

7. Horse Shows. Student is required to pay Stable a $200 non-refundable deposit of horse show fees 2 weeks prior to leaving for a show to hold their spot. The deposit will automatically be charged to the credit card on file. After the horse show, the expenses will be finalized and any remaining amounts due will be charged to Student’s credit card on file.

10.Risk Acknowledgement and Assumption of Risk/Release Waiver and Release Know all men by these presents that ( student ), for and in consideration of the equine training and teaching services, boarding, use of stabling, indoor riding arena, outdoor riding arena, and/or equine evaluation services extended to me by Denise S Finch, Forecast Farms Inc., I do hereby remise, release and forever discharge Denise S Finch and Forecast Farms Inc., their heirs, executors, administrators, successors and assigns, of and from all manner of action and causes of action, suits, debts, dues, accounts, bonds, covenants, agreements, judgments, claims and demands whatsoever in law and in equity, on account of any equine training and teaching services, boarding, and/or equine evaluation services resulting in any injury to me or my horse(s) and /or my death and /or the death of my horse(s). I express acknowledge the following: (1) Denise S Finch t/a Forecast Farms Inc., is an “Equine Activity Sponsor” and an “Equine Professional” as defined under sec 3.1-796.130 of the 1950 Code of Virginia, as amended. (2) I am a “Participant” in an equine activity as defined under sec 3.1-796.130 of the 1950 Code of Virginia, as amended. (3) Equine Activity can constitute a danger to me, my horse(s) and other persons and horses. (4) It is my responsibility prior to riding to check all of the equipment on the horse for signs of any wear or disrepair. (5) It is my responsibility to have on shoes specifically designed for riding when on or near any horse. (6) I must ALWAYS wear an ASTM and USEF approved hard hat when riding. Pursuant to sec 3.1-796.133 I expressly assume the risk of any injury and death to me. I also expressly assume the risk of any injury or death to my horse(s) from any equine activity. By my signature to this Waiver and Release I acknowledge notice of the risks inherent I equine activities, including the following: (a) The propensity of an equine to behave in dangerous ways which may result in injury to the participant; and (b) The inability to predict an equine’s reaction to sound, movements, objects, persons, or animals; and (c) The hazards of surface or subsurface conditions. This Waiver and Release shall remain valid until expressly revoked by the undersigned or the parent or guardian of the minor.
